Workplace investigations into employee misconduct

External Workplace Investigations

Workplace investigations are generally conducted to investigate complaints of employee misconduct. It will also be appropriate to conduct a workplace investigation if an employer reasonably suspects an employee has engaged in misconduct, even if no employee has made a formal complaint.

  • Procedural fairness concerns. For example, by not providing the alleged wrongdoer with an opportunity to respond or not interviewing key witnesses. 
  • Not following established policies and procedures for conducting the workplace investigation.
